European Legislation
Two new Directives on Public Procurement that replace initial Procurement Directives (92/50/EEC, 93/37/EEC, 93/38/EEC, 97/52/EC, 98/4/EC) were published on 30 April 2004 in the Official Journal of the European Union, by which four-year long legislative activity of the European Commission, the European Parliament and the Council on the so-called legislative package has been completed.
European Procurement Directives regulate in detail procedures in the course of the award of above-the-threshold public contracts; as far as below-the-threshold contracts are concerned, the Directives confine to laying down principles of transparency and non-discrimination in their award.
The basis of European legislation in the field of public procurement is:
Directive 2004/18/EC of the European Parliament and of the Council of 31 March 2004 on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts as subsequently amended.
Directive 2004/17/EC of the European Parliament and of the Council of 31 March 2004 coordinating the procurement procedures of entities operating in the water, energy, transport and postal services sectors as subsequently amended.
