National Legislation
Texts of provisions of national law must generally respect fundamental principles arising from the Treaty establishing the European Community, principles of transparency, non-discrimination, equal treatment and mutual recognition in particular, namely for the relations that are not regulated by EC legal acts directly (e.g. below-the-threshold contracts).
The Act on Public Contracts and the Concession Act have elaborated in detail procedures for the award of both above-the-threshold and below-the-threshold contracts and for concession procedures and conclusion of concession contracts; however, in doing so, they simultaneously maintain balance between the principle of transparency and that of proportionality (there is an option of considerable reductions of time limits and lower administrative burden for below-the-threshold contracts).
